Gilroy to vote on extending data center development moratorium

The future of data centers in Gilroy will be on the line Monday. There is currently a temporary moratorium on data center development in the South Bay city after community members pushed back over concerns surrounding water, power, noise and transparency. City staff on Monday are expected to recommend that the council extend the moratorium for 10 months and 15 days. Many community members say they were not given the opportunity to weigh in on any projects, and they point to the $2 billion Amazon Web Services data center that’s already under construction. That facility would not be impacted by Monday’s decision as it’s going up on 56 acres zoned for heavy industrial. A lot of community members have been voicing concerns about data center development, as has been the case in other Bay Area communities. Monday’s City Council meeting starts at 6 p.m. Community members who want to weigh in can attend in person or online.

Thirsting for some bathtub gin? Supreme Court to review ban on distilling spirits at home

The Supreme Court agreed on Monday to consider whether Congress had the constitutional authority to impose a ban on distilling spirits in private homes more than 150 years ago. Plaintiffs challenging the prohibition on home distilling claim the 1868 law is an antiquated relic of Reconstruction-era politics. They argue that Congress overstepped its taxation powers when it enacted the home distilling ban as part of a…

Passengers recount terrifying emergency landing shortly after flight takes off: ‘Evacuate!'

An American Airlines flight from St. Louis to Philadelphia turned into a terrifying ordeal for passengers on Saturday morning, with oxygen masks dropping down mid-air and passengers told to run away from the plane after an emergency landing. American Eagle Flight 5089 was scheduled to take off at around 6 a.m. Saturday from St. Louis Lambert International Airport in Missouri, but was delayed for about two hours due to an engine issue, according to NBC affiliate KSDK in St. Louis. “They came over the intercom and said that the engines wouldn’t start,” Olivia Clancy, a passenger on the flight, told the station. Clancy was traveling with her husband and two children, both of whom were flying for the first time. The plane’s engines were eventually cleared for take off, but shortly after departing passengers noticed something wasn’t right with the aircraft’s thrust. “I looked at my husband and said, ‘This is not normal,'” Clancy told KSDK. “Then, out came the airbags.” Clancy said her family put on their oxygen masks as the aircraft struggled to maintain altitude. Passengers also reported smoke on the plane. Passenger Tessa Springer said she was sure “the plane was going to go down” because of the way the flight crew was behaving, KSDK reported. Springer and her husband panicked and scrambled to text their children that they thought they might die “I’ve never experienced that before. I never want to experience it again. I just thought our kids were going to lose both their parents today,” Springer told KSDK. The pilot radioed the airport’s air traffic control tower to report the need for an emergency landing and requested “fire equipment” to assist on the tarmac, according to air traffic control audio obtained by NBC News. “We have fumes in the cockpit, we need to expedite,” a pilot can be heard telling air traffic control. The plane managed to turn around and returned to the St. Louis airport, landing just before 9 a.m. Video taken from inside the plane’s cabin captured the chaotic moments after the plane touched down, with flight attendants yelling at passengers to “evacuate, evacuate, evacuate!” “Release seatbelts, get out. Leave belonging!” a flight attendant can be heard shouting in video shared by Clancy. Clancy told KSDK that as passengers scrambled to get off the plane, crew members told them to run. “So, we were just running … You don’t know if this plane is going to blow up,” Clancy said to KSDK. In a statement to NBC News, a spokesperson for American Airlines said the plane landed safely after reports of an odor onboard and no injuries were reported. It added the plane was taken out of service for inspections. “We apologize to our customers for their experience and thank our team members for their professionalism,” the statement said. Clancy and Springer raised concerns about how the airline’s crew members and airport’s staff handled the entire situation, from failing to address the engine issue before take off to not better managing the confusion on the ground once they landed. “At what point did they decide you’re checked, you’re cleared to take the air? What was wrong and what made it OK?” Springer told KSDK. For Clancy, American Airlines’ response to passengers made her frustrations even worse. “I got an email from American Airlines that said, ‘We’re so sorry about your flight, here are four $12 food vouchers that you can use for your party at the airport if you choose to stay. (It felt like) a slap in the face,” Clancy told the station.

Engine failure may have caused small plane to crash in San Jose

Engine failure may have caused a small plane to crash on one of San Jose’s busiest streets on Saturday, according to air traffic control recordings. Two adults and a child were in the plane when it went down at the intersection of Capitol Expressway and Excalibur Drive. They did not suffer any life-threatening injuries, the San Jose Fire Department said. Air traffic control recordings indicate the pilot was in trouble before the crash. “We are having engine failure,” the pilot could be heard saying. “I’m declaring an emergency.” The Cessna 177 aircraft was based at Reid-Hillview Airport in East San Jose and was part of a flight club linked to San Jose State University. In a statement, the university said, “The aircraft involved is owned and operated by Flying20, an independent flying club. While Flying20’s membership includes some San Jose State University alumni, employees and students, the club is not operated by the university.” The vice president of the flight club declined to comment about the crash. Neighbors said this was not the first time a plane flying out of Reid-Hillview has crashed near their homes. Maria Reyes has lived near the airport for 54 years and said she wants Reid-Hillview to close to protect her neighborhood. “We live with the constant fear of another airplane flying into our community and crashing,” she said. “People don’t seem to understand that that’s an anxiety that we live with day in and day out. We don’t know if there’s going to be another crash.” The fire department said it responded to another plane crash at Reid-Hillview Friday night. No one was hurt. The FAA said it’s investigating. NBC Bay Area reached out to the NTSB but did not immediately receive a response.

Elderly couple accused of killing son-in-law in Dublin plead not guilty

An elderly couple accused in the killing of their son-in-law in Dublin last month pleaded not guilty Monday to charges of first-degree murder with special circumstances of lying in wait. Shili Chen and Shouyong Zhang, both 77, allegedly shot their son-in-law, 40-year-old Jonathan McKinsey, to death on Sept. 26 in the parking lot of a sports complex in Dublin. Curtis Briggs, an attorney for Chen, said McKinsey was at the complex for a supervised visit with his children, who he shared with his estranged wife Candice Jang. Briggs claims Chen did not premeditate the alleged crime but rather saw something that made her and Zhang concerned about the safety of their grandchildren and forced them to act. Briggs did not elaborate. Briggs did say McKinsey allegedly threatened to kill Chen at least three times, including once with a hitman. McKinsey, a gaming engineer for The New York Times, and Jang were in the midst of a bitter divorce and child custody dispute, both accusing the other of physical and emotional abuse. Investigators said Chen had a gun on her when she was arrested. They said they found a second gun in the couple’s car. Briggs said the couple purchased the guns in March for their own protection against McKinsey. A bail hearing was set for Nov. 4, followed by a pre-trial hearing on Nov. 23. Federal authorities charged more than two dozen foreign nationals Monday in California as part of a statewide sweep targeting people who officials say have illegally registered and voted in U.S. elections. The arrests are part of a Trump administration effort to root out noncitizen voting ahead of next month’s midterm elections, even though data shows that the problem is incredibly rare, difficult to prove and…
